Spirit of Harrogate Limited (the Promoter) Slingsby Scratch to Win scratch card promotion 2021/2022 (the Promotion) – Consumer rules (the Rules)

1. Background

The Promoter has procured the production of 100,000 Slingsby scratch to win scratch cards (hereafter referred to as scratch cards). Every scratch card is an instant win and contains either a prize (as more particularly described at clause 6 and each prize outlined at clauses 6.3.1 and 6.3.5) being a prize and together the prizes) or an offer, allowing the scratch card holder to purchase any Slingsby gin variant at a participating golf club and receive another half price (the Offer). The terms on which such prizes and Offers can be claimed are set out in these Rules. For details of participating venues please email info@spirtofharrogate.co.uk

2. The Promoter

The Promoter is Spirit of Harrogate Limited a company registered in England and Wales with company number 09193835 and whose registered office address is at ICB Brands Holdings Limited, 4 Sceptre House, Hornbeam Square North, Harrogate, North Yorkshire, HG2 8PB.

3. Eligibility

  • Each entrant must be aged 18 or over and a UK resident to participate in the Promotion. The following are not eligible to participate:

  • employees of the Promoter or any companies within its corporate group;

  • employees of agents or suppliers of the Promoter or any companies within its corporate group, who are professionally connected with the Promotion or its administration; or

  • members of the immediate families or households of 1.1 and 3.1.2 above

  • In entering the Promotion, you confirm that you are eligible to do so and eligible to take up the Offer should you wish to and claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Promotion and any prize may be withheld unless and until the Promoter is satisfied with the verification.

  • There are no collective or individual prize limits.

  • The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Promotion.

4. Duration

  • All scratch cards have been distributed by the Promoter on a random basis amongst participating golf clubs in Great Britain (excluding Northern Ireland) and participation in the Promotion is scheduled to take place from 30 June 2021 until:

    • in the case of the prizes 20 August 2022 (the Closing Date) and any entries received after the Closing Date are automatically disqualified; and

  • in the case of the Offer until such time as the scratch cards for the Promotion run out.

5. How to enter

  • Entrants simply purchase a gin and tonic at a participating golf club in Great Britain (excluding Northern Ireland) and whilst stocks last, each entrant will be issued with a scratch card.

  • An entrant should scratch off the copper tab on the scratch card and each scratch card contains an instant win message which will inform the entrant if they have won a prize or whether they are entitled to take part in the Offer.

  • If the entrant is entitled to take part in the Offer and would like to do so, the entrant needs to present the scratch card when ordering at a participating venue.

  • If the entrant has won a prize, they should follow the instructions set out at clause 7. Please note that in order to claim any prize, it is mandatory to send the winning scratch card to the Promoter as a pre-condition to the prize claim being verified. It is therefore important that scratch cards are kept safe and undamaged and failure to do some may result in the Promoter determining (in its discretion) that the scratch card together with the associated prize claim is void.

6. Prize descriptions and conditions

  • Before a prize claim for any prize may progress, all prospective winners must first notify the Promoter of their prize claim in accordance with clause 7.

  • The specific conditions attaching to each instant win prize are:

  • Ultimate golf weekend in Dubai – flights, hotel and tickets for two to watch the season ending finale in 2022 - one to be won.

The ultimate golf weekend in Dubai prize (the Ultimate Golf Weekend) is awarded as a three-night trip for the winner and one nominated companion. If the winner’s nominated companion is under 18, responsibility for the companion must have been accepted by the winner. The Ultimate Golf Weekend will comprise for the winner and their nominated companion, the following: (i) economy class direct, return flights between an airport in the UK (as determined by the Promoter in its sole discretion) and Dubai Airport, (ii) three nights standard hotel accommodation in either a shared standard twin or double room and any applicable tax only at a 4-star hotel in Dubai (such hotel to be determined by the promoter in its sole discretion, (iii) two tickets to watch a season ending golf finale in 2022 (such day of the event and type of ticket to be determined by the Promoter in its sole discretion).Travellers are solely responsible for obtaining at their own cost all requisite passports, visas, other travel documentation and insurance for all applicable risks for all members of their party and are required to check with any relevant authorities regarding passport and visa requirements. The Ultimate Golf Weekend must be booked through the Promoter at least two months prior to intended departure date. Bookings are likely to be restricted during periods of high demand, particularly school holidays and bank holidays. Travel, accommodation and other elements of the prize are all subject to availability and to Promoter approval. Any costs incurred additional to the prize elements as described are at the expense of the winner and/or their companion (including, without limitation, transfers to and from Dubai airport, spending money, insurance, meals, security charges, unspecified ground transportation, phone calls, baggage, gratuities, incidentals, and souvenirs). Once issued, all tickets are non-transferable and may not be reissued. Travel tickets are not open and stopovers are not permitted. Travel arrangements must be made through the Promoter and its designated travel operator. In the case of the companion being a minor whose parent or legal guardian is not the winner, the minor will be required to provide a signed form by which that minor’s parent or legal guardian nominates the winner to be responsible for the minor during the Ultimate Golf Weekend in the parent or legal guardian’s place, as well as requiring a further signed form by which the winner undertakes to accept that responsibility in respect of the minor. Please also note clause 6.4.

  • Set of Callaway Golf Clubs – two sets to be won (the Callaway Prize)

Each Callaway Prize consists of a set of a Callaway Golf Clubs, (such set to be determined by the Promoter in its sole discretion). 

  • Weekend stay at Rudding Park with Slingsby gin experience– five to be won (the Rudding Park Break).

Each Rudding Park Break comprises a two nights’ break for the winner and a companion at Rudding Park,  Rudding Ln, Follifoot, Harrogate HG3 1JH in either a shared standard twin or double room. .All bookings are subject to availability. Bookings may be restricted over school holidays and bank holidays. Meals, transfers, travel insurance and anything else not expressly stated as provided, remain the sole responsibility and cost of winner and/or their companion. All additional hotel-spend (such as other meals, bar bills and newspapers) must be paid for in full prior to departure.

The Promoter requires three months’ notice from the winner of the intended date of the Rudding Park Break and the Rudding Park Break must take place within 12 months of receipt by the Promoter of the winning scratch card.

As part of the Rudding Park Break, the winner and their companion will also be able to attend a gin experience provided by the Promoter at its retail premises at 5-7 Montpellier Parade, Harrogate, HG1 2TJ. The companion must be over 18 years old to attend the gin experience. Gin experiences are subject to the Promoter’s availability and the Promoter will use all reasonable endeavours to ensure that the winner and their companion can attend a gin experience to coincide with their stay at Rudding Park.   • BMW PGA Championship 2022 tickets for two with overnight stay– 10 to be won (the PGA Prize).

The PGA Prize comprises two tickets for the BMW PGA Championship 2022 (such day of the championship and type of ticket to be determined by the Promoter in its sole discretion) and a one-night break for the winner and a companion in either a shared standard twin or double room at a four-star hotel within a reasonable distance of the BMW PGA Championship (such hotel and its location to be determined by the Promoter in its sole discretion). The break must be booked by 26 August 2022. Travel to the hotel and from the hotel to the BMW PGA Championship and back again is the responsibility of the winner and/or their companion and hotel-spend (such as meals, bar bills and newspapers) must be paid for in full prior to departure. Any costs incurred additional to the PGA Prize elements as described above are at the expense of the winner and/or their companion (including, without limitation, spending money, insurance, meals, drinks, gratuities, incidentals, and souvenirs). Please also note clause 6.4.

  • Slingsby Gin hamper – 10 to be won.

The Slingsby Gin hamper comprises one bottle of Slingsby London Dry Gin, one bottle of Slingsby Rhubarb Gin, two branded Slingsby gin glasses and a selection of tonics. Please also note clause 6.4.

  • The following conditions are applicable to all prizes:

  • The expression prizes when used in these Rules shall include the prizes outlined in clause 3 as well as the corresponding services and/or goods available to be redeemed through the use of such prizes. Prizes (including individual elements of a prize) may not be exchanged for any cash or other alternative and prizes are not transferable, negotiable, divisible or permitted to be sold or resold.

  • The Promoter nor any redeeming outlet of a prize shall be under any obligation to enquire whether the person submitting any scratch card:

    • is the person entitled to make the claim, irrespective as to whether or not that person first obtained that scratch card,

    • is otherwise eligible to claim the prize, or

    • has supplied accurate and true details to ensure that a prize is only claimed by and fulfilled for the benefit of the winner, and no such enquiry or omission to make enquiry shall affect the Promoter’s rights in relation to anyone in breach of the Rules, including the right to disqualify anyone who sells or gives away a scratch card.

  • By claiming a prize the winner represents for the winner and, if relevant, his or her companion sharing the prize, that (in addition to agreeing to the Rules) each agrees to the terms and conditions relating to the prize, any element of the prize or the redemption of goods or services using the prize of the prize supplier. If any such terms and conditions conflict with the interpretation of these Rules then the latter shall prevail.

  • All unawarded or unclaimed prizes will lapse if not the subject of valid claims by the Closing Date.

7. How to claim prizes

  • Before claiming any prize, please pay particular attention to clause 2 below and note that:

  • each prize claim must be submitted in accordance with all instructions and deadlines given in the Rules and any failure to do so will cause the prize claim to lapse and the corresponding scratch card to become void;

  • it is the entrant’s responsibility to contact the Promoter in the event of non-receipt of any communication stated in these Rules – all deadlines and time limits shall continue to apply regardless of such non-receipt; and

  • scratch cards must be kept safe. The Promoter will require to see an entrant’s scratch card before any prize is awarded and the entrant must post (at the entrant’s expense) the scratch card used in the entrant’s prize claim (and, it is recommended that scratch cards be sent in an envelope by Special Delivery from a post office). Failure to present any scratch card when required will result in the corresponding prize claim becoming void, whereupon the prize will be withheld or cancelled.

  • To start a prize claim go online before the Closing Date and email info@spiritofharrogate.co.uk using “Slingsby Scratch to Win!” as the email subject heading. In the email the entrant must provide details of the prize claimed, together with the entrant’s date of birth (to confirm eligibility), email address, phone number and full name and UK residential postal address. If possible, the entrant should attach a photograph of the scratch card. Please note that if a photograph of the scratch card is provided, this does not negate the requirement for the entrant to post the scratch card in accordance with clause 1.3.

  • After the entrant has finished the stage of emailing info@spiritofharrogate.co.uk and providing the information requested in clause 2 above, the entrant will then be contacted by the Promoter on the phone number submitted or the email address provided to continue the prize claim. This will be between 09.00 and 17.30 Monday to Friday (inclusive) excluding Bank Holidays, and the Promoter will seek to contact the entrant as soon as is reasonably practicable to facilitate the claiming and administration of the relevant prize. The Promoter will ask the entrant to submit their scratch card in accordance with clause 7.1.3.

  • The Promoter does not accept any responsibility if an entrant is not able to take up a prize.

8. Responsibility

To the fullest extent permitted by applicable law (but not otherwise) the Promoter assumes no responsibility and is not liable for: (ii) the non-availability, loss, interception or interference with, late or non-receipt, corruption or damage of or to any scratch card, prize or notification or other communication, (iii) (other than those warranties or conditions implied by statute and which cannot be excluded by the Promoter) any representation, warranty, condition or guarantee in respect of a prize, (iv) any taxes, fees, charges or other costs which winners may be required to pay at any time in connection with a prize, (save to the extent that the Promoter has expressly and specifically accepted responsibility in these Rules for the same), or (v) any actual or perceived loss of opportunity or damage arising in connection with the termination or suspension of the Promotion (or any part, feature or element of the Promotion) at any time and which suspension or termination is due to supervening circumstances beyond the Promoter’s control (although the Promoter will still honour any valid claims received prior to the termination or suspension).

8. The Promoter’s rights

The Promoter may (i) extend any time limit, exercise a right of discretion or waive any of the Rules where a person might otherwise have been disqualified or otherwise disadvantaged (without obliging the Promoter to extend any time limit, exercise a right of discretion or waive any Rule on any further occasion for that entrant or at all for any other person), (ii) terminate or suspend the Promotion (or any part, feature or element of the Promotion) at any time due to supervening circumstances beyond the Promoter’s control including (without limit) those which the Promoter determines have or are likely to compromise the security or credibility of the Promotion (or the affected part, feature or element of it), and (iii) substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the Prizes (or any part of a Prize). The Promoter’s decision in the exercise or interpretation of any of its rights or discretions in connection with these Rules shall be final and binding and reference to the discretion of the Promoter shall mean its sole discretion.

9. Privacy

  • Please see  https://www.spiritofharrogate.co.uk/privacy-policy/for details of our privacy policy applying to this Promotion. See also clauses 2 and 10.3, with regard to the announcement of winners.

  • The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname to anyone who emails info@spiritofharrogate.co.uk or writes to Promoter’s registered office address within one month after the Closing Date.

  • If you object to your surname, being published or made available, please contact the Promoter at info@spiritofharrogate.co.uk. In such circumstances, the Promoter must still provide the information to the Advertising Standards Authority on request.

10. General

  • To the extent that the Promoter publicises the Promotion on any social media platform such as Instagram or Facebook it shall not thereby be implied that the social media platform provider is jointly or solely sponsoring, endorsing or administering the Promotion.

  • Nothing in these Rules shall affect the statutory rights of entrants.

  • The Promoter may (in its discretion) (i) alter these Rules during the Promotion to the extent it considers necessary or desirable to maintain and preserve the integrity and reputation of the Promotion or the fair, effective or secure operation of the Promotion (and altered Rules will be notified and made available for review on the Promoter’s website, and (iii) perform any stated function in these Rules via an agent and the entrant shall be required to accept such performance as if it was directly by the Promoter.

  • These Rules shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
